Constitutional Court may be asked to clarify Zelenskyy’s legitimacy – report

According to Ukrainian law, elections — presidential, parliamentary, or local — are not held during martial law.

At the same time, per the Ukrainian Constitution, regular presidential elections were scheduled for March 31, 2024, as Zelenskyy's five-year term, starting from the date of his inauguration, is set to expire on May 20, 2024.

Journalists write that the President’s Office is still deciding how to proceed after May 20.

"One option under consideration by the [President’s] Office is to seek an official interpretation from the Constitutional Court on constitutional provisions regulating the conduct of presidential elections and the president's five-year term," the article said.

Relying on its sources within the President's Office, ZN.UA writes that this appeal to the Constitutional Court has been prepared and aims to ask several questions. The first, according to their information, is: Does the Constitution allow for presidential elections during martial law? The second relates to the legitimacy of presidential authority after the five-year term concludes on May 20.

However, the President's Office has not yet decided how to proceed with the appeal, fearing a potentially unfavorable ruling.

“Many in the president's team believe the appeal to the Constitutional Court is belated,” the report said.

“But the main deterrent factor is the lack of confidence in the office that they will receive a prompt and, more importantly, favorable decision from the court.”
