$15M settlement for man who fell through N.J. condo’s pool stairs

A Bergen County man severely injured when he fell through a wooden stairway while working at a condominium swimming pool has agreed to settle his lawsuit for $15 million.

James Visconti, 59, of Saddle Brook, was servicing the pool at Harmon Cove IV community pool in Secaucus on Sept. 6, 2018, when wooden steps collapsed beneath him, sending him to the pavement below, according to court papers.

Visconti, an employee of Preferred Pool Management Inc., of Fairfield, sustained injuries so serious he was forced to leave his job and has been disabled ever since, according to a December 2019 lawsuit filed in Superior Court of Hudson County.

The injuries included tears in his left knee and disc ruptures in his spine, according to court documents.

The lawsuit named as defendants the Harmon Cove IV Condominium Association and the Wilkin Management Group, Inc.

Jennifer L. Moran, an attorney representing the condominium association, said on Thursday she had no comment on the settlement. Visconti’s attorney did not respond to requests for comment on the lawsuit or the settlement.

According to court documents obtained by Law.com, Visconti put his foot on the second step, the tread detached from the stringer, his right foot hit the pavement and he fell onto his back.

He underwent surgery, and was eventually diagnosed with complex regional pain syndrome, a condition characterized by pain that is greater than would be expected from the injury, Law.com reported.

Visconti is unable to walk, bathe or dress himself and he frequently experiences nausea and vomiting because of the pain, Law.com reported, citing a court document.
