Donald Trump's behavior Tuesday was a major trade down from an opening day in his New York hush money trial that saw the former president dozing off in court, a legal expert contends.

Tristan Snell, a former New York assistant attorney general, made this point while discussing with MSNBC host Nicolle Wallace Judge Juan Merchan's stern reprimand about jury intimidation in Trump's criminal hush money trial.

"You know, I think that the folks that have been joking online that maybe the best thing that Trump could do for his team is to fall asleep — as he looked like he did yesterday," said Snell. "I would agree with that."

Jury selection has begun this week in the first of four criminal court cases facing the former president. Manhattan District Attorney Alvin Bragg contends Trump falsified business records to cover payments made to adult film star Stormy Daniels ahead of the 2016 presidential election.

Trump has pleaded not guilty and hinted he might testify.

Butt Snell argues the less Trump does, the better things will work out for him.

"Napping is a great way for him to get through this," Snell cracked. "For him to start getting into a huffy-puffy, big bad wolf mode with the jurors is going to inch him closer and closer to some serious consequences. They are still just baby-stepping this along."

Snell then brought up the $1,000 fines Bragg requested over three potential breaches of Trump's gag order.

"The more that he does things like that, the worse it is going to be," Snell said. "If I'm his team, I'm sitting there, 'Oh, God, how could we get him through this without him making a total mess of everything?'"
