Florida AG Ashley Moody, 17-State Coalition, Sues Against Biden’s EEOC Abortion Mandate

As part of a coalition of 17 states, Florida Attorney General Ashley Moody is suing the federal Equal Employment Opportunity Commission for enforcing a new rule that "illegally interprets" the Pregnant Workers Fairness Act of 2022 to require private and state employers to accommodate abortion.

“Unelected commissioners under the Biden administration are seeking to hijack protections for pregnant workers by twisting language into an illegal interpretation of the Pregnant Workers Fairness Act of 2022. We are fighting back against the unprecedented, attempted mutation of these laws," said Moody.

The PWFA closes a legal loophole at the federal level by guaranteeing pregnant workers in the workplace access accommodations to safeguard their pregnancies and unborn children.

That pro-family goal was backed by a broad coalition of legislators, business associations, and nonprofit organizations, and it received strong bipartisan support.

Yet in a new rule, unelected commissioners at the EEOC seek to hijack the protections for pregnancies by requiring employers to accommodate women’s elective abortions or face a federal suit—something the U.S. Congress clearly did not authorize. Further, the EEOC’s rule contradicts states’ duly enacted abortion prohibitions and undermines the states’ commitment to protecting prenatal life at all stages of development.

If the EEOC’s rule stands, Florida, the co-plaintiff states, and others must allocate resources to support women’s elective abortions or face a federal suit—even if illegal under state law. Seventeen states now bring this complaint to enjoin and set aside the EEOC’s unprecedented and unlawful abortion accommodation mandate.

The following state attorneys general have joined Attorney General Moody in filing the lawsuit: North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, and West Virginia; Arkansas, Alabama, Georgia, Idaho, Indiana, Iowa, Kansas, Missouri, Nebraska, and North Dakota.
