Biden Admin Seeks Dismissal Of College Accreditation Lawsuit In Florida

A federal judge will hear arguments Monday on the Biden administration's request to dismiss a lawsuit filed by Florida challenging the constitutionality of an accreditation system for colleges and universities.

Accreditation plays a vital role in higher education, in part, because schools must be accredited for students to receive federal financial aid. In the lawsuit filed in June, Florida argued that the system gives too much power to private accrediting agencies.

However, in a motion to dismiss the case, attorneys for the U.S. Department of Education said the federal government relies on accrediting agencies to help ensure that colleges and universities meet standards.

Florida Attorney General Ashley Moody’s office filed the lawsuit after clashes between state officials and the Southern Association of Colleges and Schools Commission on Colleges, the longtime accrediting agency for Florida colleges and universities.

U.S. District Judge Jacqueline Becerra will hold a hearing in Miami on the motion to dismiss the case, according to an online docket.
