The International Criminal Court (ICC) made a decision to seek arrest warrants against Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant for alleged war crimes in Gaza.

As the United States has long been a staunch ally of Israel, President Biden and Secretary of State Antony Blinken have forcefully condemned the ICC's move, calling it "outrageous" and questioning the legitimacy of the investigation.

In a dramatic announcement, ICC Chief Prosecutor Karim Khan revealed that his office had applied for arrest warrants against Netanyahu and Gallant, as well as three senior Hamas leaders, including Gaza chief Yehiya Sinwar.

The charges against the Israeli officials include "causing extermination, causing starvation as a method of war, including the denial of humanitarian relief supplies, and deliberately targeting civilians in conflict."

Meanwhile, the Hamas leaders face accusations of "extermination, murder, taking of hostages, rape and sexual assault in detention."

Khan emphasized that while Israel has the right to defend its population, it is still bound by international humanitarian law, and the alleged crimes against Palestinian civilians appeared to be part of a "widespread and systematic attack."

The Biden administration's response was swift and unequivocal. President Biden described the ICC's move as "outrageous," categorically rejecting any equivalence between Israel and the Hamas terrorist organization. "Let me be clear: whatever this prosecutor might imply, there is no equivalence — none — between Israel and Hamas," he declared.

Secretary of State Blinken echoed these sentiments, calling the ICC's decision "shameful" and stating that the United States "has been clear since well before the current conflict that the ICC has no jurisdiction over this matter." Blinken argued that the ICC's principles of "complementarity" had not been properly applied, as Israel's own legal system was prepared to investigate the allegations.

The Biden administration's forceful pushback against the ICC's warrants is rooted in its longstanding support for Israel and concern over the potential impact on ongoing diplomatic efforts. U.S. and Israeli officials have revealed that the ICC prosecutor had been engaged in quiet negotiations with both countries in recent weeks, discussing the investigation and even planning a visit to Israel next week.

Benny Gantz, a member of Israel's war cabinet, has condemned the move as "a crime of historic proportion to be remembered for generations."

The pro-Israel NGO Monitor has also denounced the ICC's actions, with legal advisor Anne Herzberg describing the case as "yet again the exploitation of international institutions in service of malevolent agendas." Israel's staunch refusal to cooperate with the ICC investigation and its unwavering support from the Biden administration suggest that the legal battle is far from over.

The Palestinian Perspective

In contrast, the ICC's decision has been hailed by some as a significant step towards accountability and justice for the Palestinian people. Sarah Leah Whitson, the executive director of the nonprofit Democracy for the Arab World Now (DAWN), has described the arrest warrants as "a milestone in accountability in the face of decades of impunity for war crimes and crimes against humanity in Palestine."
