'He's not capable of it': Ex-prosecutor reveals what will trip Trump up at sentencing

Former federal prosecutor Harry Litman said that one major thing will trip up Donald Trump when he faces his sentencing.

He, along with legal analyst Andrew Weissmann, listed a series of requirements that Trump now faces as a convicted felon. For example, Trump can't possess a gun, and he can't get a real estate license.

Litman told host Nicolle Wallace that certain countries will not allow Trump to enter them as a felon anymore. Weissmann said that it is up to the judge to decide if Trump can travel internationally.

One requirement is a sentencing memo in which each side will make its pitch for the ex-president's sentence.

"There will be a pre-sentence report," said Weissmann. "And he's going to go in, and that person is going to ask him everything about himself. He is going to have to answer all sorts of questions about his finances and his background."

He explained that the purpose is for both sides to document recommendations based on a series of things that are calculated.

"It includes: who is the offender? And what are the offense characteristics?" Weissmann listed off. "So, remorse, recidivism. The judge has to decide [if a] fine should be imposed. To do that, you need to know about the financial wherewithal of the defendant."

All of the things are "standard" for any defendant, he said.

"It's not being imposed on him. This is — he made the choice," Weissmann said. "He was given a trial. And the jury found that he did it. So, all of this is something that every defendant who has made a choice, a poor one, and is found guilty of is subject to."

Wallace wondered which Trump would "show up" to the meeting where he has to be on his best behavior and give the court the answers politely.

"We know what Trump is going to show up!" Litman exclaimed.

"This is the point where every lawyer tells his convicted client, 'Okay, now, go there and show you're repentant. For God's sake, you're a convict!' He's not capable of it," Litman said. "He's gonna sit down in this grimy room and just continue to fulminate. That'll show up in he report. It's something that [Judge Juan] Merchan can take account of."

Reporter Vaughn Hillyard said that watching Trump's speech in his building lobby Friday displayed just how little remorse Trump has.
