Gov. Kristi Noem (R-SD) and CNN's Erin Burnett locked horns over the contention that President Biden's Justice Department was pulling the legal strings in Donald Trump's New York State criminal conviction.

"Look at what happened this week, what President Biden and his team have been able to do: to distract America with this trial and we're not talking about the open Border," she told the host. "The fact that President Biden is violating federal law by allowing this [sic] —."

Burnett cut her off, then made clear the case wasn't prosecuted by the feds.

"Governor, I do think it's important to note that this trial was not brought by Department of Justice, which is bringing a case against President Biden's son Hunter Biden; that starts next week. This case, the Department of Justice did not choose to pursue against Trump."

"It was brought by New York so you just said that it's President Biden's case that's not true."

Trump was convicted of all 34 counts of committing falsification of business documents in an attempt to buy the silence of alleged affairs with a porn star and ex-Playboy playmate in order to influence the 2016 election.

Trump has vowed to appeal.

Noem tried to make it seem as though there were a cabal of legal tentacles being utilized to buttress the Manhattan DA's office to prosecute the case.

"We all know that the Obama Administration officials that were moved to this DA's office in order to bring forward this type of action against President Trump and we all recognize that Hillary Clinton did this exact same thing and she paid a fine for it and instead when it's president Trump and no crime was committed and he did nothing wrong instead they bring 34 felony accounts and convictions against him. It's complete different judicial treatment."

She's likely pointing to Matthew Colangelo, who was a former high-ranking official in New York Attorney General Letitia James’ office.

His name rang out when Rep. Jim Jordan (R-OH) accused the Bragg’s office of “politicized prosecution” against Trump.
