ICE: Rhode Island Releases Illegal Immigrant Who Raped Person With “Severe Mental Handicap”

ERO Boston apprehends Colombian national charged with sex crimes against Rhode Island resident (ICE)

The Enforcement and Removal Operations (ERO) Boston unit recently apprehended a Colombian national charged with a disturbing array of sexual assault and assault crimes against a Rhode Island resident with a severe mental handicap.

This apprehension not only highlights the critical role of ERO in safeguarding our communities but also serves as a stark reminder of the urgent need to address the scourge of sexual violence perpetrated by noncitizens who seek to exploit the vulnerable.

On May 22nd, deportation officers from the ERO Boston's Providence field office apprehended Rigberto Hoyos-Alban, a 33-year-old Colombian national, in Cranston, Rhode Island. Hoyos-Alban's arrest came on the heels of a series of charges leveled against him, including four counts of sexual assault and one count of assault against a person with a severe mental handicap.

Hoyos-Alban's criminal history dates back to November 2023, when the U.S. Border Patrol arrested him near the Rio Grande Valley in Texas after he had unlawfully entered the United States without proper inspection, admission, or parole by a U.S. immigration official.

Despite being issued a notice to appear before a Department of Justice immigration judge, Hoyos-Alban was released on his own recognizance.

Then, the Central Falls Police Department in Rhode Island arrested Hoyos-Alban on March 13th, charging him with two counts of sexual assault in the first degree, two counts of sexual assault in the second degree, and one count of felony assault on a person with a mental impairment.

Deportation officers from the ERO Boston's Providence field office promptly lodged an immigration detainer against him with the Rhode Island Adult Correctional Institute on March 14th.

However, the facility failed to honor the detainer and released Hoyos-Alban from custody, a missed opportunity that could have prevented the subsequent apprehension.

“Rigberto Hoyos-Alban has been charged with four counts of sexual assault and one count of assault aganst a person with a severe mental handicap,” said ERO New England Field Office Director Todd M. Lyons. “This is not the type of individual we want walking the streets of our New England neighborhoods. ERO Boston will continue to prioritize the safety of our public by apprehending and removing violent noncitizens from our comunities.”

The deportation officers from ERO Boston's Providence field office apprehended Hoyos-Alban in Cranston on May 22nd. Hoyos-Alban is currently in ERO custody, awaiting the outcome of his removal proceedings.
