Drink-driver caught in Upwell had thrown parcel at ex-partner in Wisbech home

A drink-driver threw a parcel at his ex-partner and hurled a bowl of coleslaw across the room before getting behind the wheel.

Ian Batts, 39, of no fixed address, appeared at Lynn Magistrates’ Court on Thursday, where he was sentenced for a total of four offences.

In a previous hearing, he had admitted assault by beating, causing criminal damage, driving above the specified alcohol limit and obstructing a constable in their duty.

Prosecutor Amir Khan said that the offences took place on April 29, when an argument broke out at the victim’s home in Wisbech.

It was during this argument that Batts threw a parcel at the victim and a bowl of coleslaw at the wall.

The victim said that as a result of the assault, she was left with a red mark and slight discomfort.

Batts then proceeded to drive back the boat which he lives on. It was parked in Upwell, and he was pulled over by police.

A breath test came back with a reading of 85mcg of alcohol per 100ml of breath. The legal limit to drive is 35mcg.

In mitigation, Charlotte Winchester said that Batts has been remorseful about his actions and has struggled with his mental health.

“Alcohol has been used as a crutch to get him through that,” Ms Winchester said.

“He is extremely sorry for his behaviour. There had been an argument where he threw the parcel and the coleslaw and then was asked to leave and he stupidly went back to his boat.”

Batts was handed a 12-month community order which will entail him completing a mental health treatment programme.

He was also disqualified from driving for 40 months and fined £120, and will also pay a victim surcharge of £114 and court costs of £85.

A 12-month restraining order was also imposed which means Batts cannot contact the victim or go to her home address.
