Josh Duggar wants his child pornography case dismissed.
The disgraced reality TV star, who was indicted on federal child pornography charges in April, is reportedly claiming the disturbing images of naked children found on his work laptop was downloaded by an employee.
New court papers allege that people had access to Duggar's used car lot’s wireless internet, The Sun reported, therefore, someone else could have illegally downloaded the images.
The 19 Kids and Counting alum's lawyers are asking for the case to be tossed out, alleging law enforcement who interviewed the employees “failed to preserve any evidence obtained during these searches.”
A witness — who was questioned on December 16, 2019 and was described as a “person of interest” — admitted to working at the car lot and on “several occasions” would sleep there “overnight without Duggar’s knowledge or permission.”
“Witness #1 admitted to viewing adult pornography through websites he accessed through the internet on his cellular phone and, when asked by these federal agents, denied viewing child pornography,” the docs stated.
The lawyers are fuming, saying police “preserved no evidence whatsoever from the search of Witness #1’s phone including its contents and metadata” that could be helpful to their client. Authorities reportedly searched the unknown person's cell and found zero evidence of child porn.
The court papers mention two other witnesses whose devices were examined and the lawyer's claim that evidence was not preserved either.
In April, Duggar pleaded not guilty to charges of receiving and possessing child pornography. He was released from jail a week after his arrest.
He was granted unlimited contact with his children — Mackynzie Renée, Michael James, Marcus Anthony, Meredith Grace, Mason Garrett and Maryella Hope — as long as his wife Anna is present during visitation. He is not allowed to be around any other minor children, including his nieces and nephews.
His trial has been postponed until November so his defense team can have “more time to review evidence.”
