Trump's gag order ploy doomed to fail — even if he wins: Former prosecutor

A judge refused a delay motion from former President Donald Trump as he appeals a gag order from Judge Juan Merchan barring him from incessantly attacking court officers and the judge's own family.

The worst part for Trump, former federal prosecutor Elie Honig explained on CNN Tuesday, is that even if Trump is ultimately successful in his bid to remove the gag order, it won't actually do anything to help him.

"Donald Trump's first criminal trial remains on track to begin on Monday after his latest request for delay was denied, an appeals court judge refusing tonight to push back the start dates or Trump can check challenge the gag order imposed on him in the case," said anchor Wolf Blitzer, turning to Honig. "Trump has been rejected now, twice in two days for these last-ditch delay tactics over the gag order and the trial venue. Does Trump have a chance with the full appeals court?"

Honig stated that he didn't believe so. "No, I don't think he does."

"As you said, he's already lost the gag order issue twice, and the ruling the reason for that is because the gag order is really narrow," Honig continued. "All it does is prohibit Donald Trump for making public comments about witnesses, about jurors, and about staff and their family members. He is still allowed to aggressively criticize the judge, the D.A., the case against him, as he has done over the past week. So Donald Trump will have a chance to brief this to the full appeals court, but I don't think he's got any chance of winning."

Furthermore, Honig added, "whatever happens with this gag order will have no impact on the trial start date because even if Trump somehow succeeds in getting this gag order overturned, you just carry on with the trial without a gag order in place. So those two things are unconnected."
