Denied: Trump loses third attempt to delay criminal trial this week

New York Associate Justice Ellen Gesmer rejected an effort to delay Donald Trump's hush money trial for a third time this week.

Trump attorney Emil Bove asked the appeals court to delay the trial by filing a sealed civil action against Judge Juan Merchan, who is overseeing the criminal case.

Bove argued, among other things, that Merchan benefited from Trump's prosecution because his daughter worked for a political consulting company. But Bove told Gesmer he could not prove the allegations because of an "information deficit."

"There is no evidence to suggest that Justice Merchan stands to benefit from the outcome of this trial," prosecutor Lisa Evan said on behalf of the District Attorney's Office.

In the end, Gesmer denied the motion.

"After hearing argument from counsel for all parties, the court denies movant's application for a stay of the proceedings," the ruling said.

The decision marks Trump's third failure this week to delay his criminal trial at the appellate level.
