Donald Trump could be the biggest obstacle in avoiding a jail sentence, a former New York prosecutor said Saturday.

Catherine Christian, a onetime assistant district attorney in the Manhattan District Attorney's office, appeared on MSNBC over the weekend, where she was asked about the possibilities of what Trump could have in store after being convicted of 34 felony counts in the hush money cover-up case.

She explained that the judge could offer Trump time served, probation, jail, or even prison. She said it would be a tough call for the judge.

Asked about sentencing factors, Christian noted that there are some mitigating examples, such as that Trump has never previously been convicted of a crime. Another factor, that Trump is 77 years old, likely won't be raised by the ex-president's team, according to the ex-prosecutor.

"So his lawyers could argue, he's 77, 78, but I thought he was a youngster in the race," the host said on Saturday. "I thought they were arguing that Biden was old now they will have to argue he is old?"

"He won't let them do that," Christian replied. "If I were representing him, which I wouldn't be, but you would say, your honor, my client is 78."

She continued:

"The aggravating circumstances is he has three open indictments in three different jurisdictions, he has civil liability, he was found liable for abuse, defamation, fraud, involving the Trump University, involving the Trump Organization, and he has also violated this... judge's gag order multiple times."

"He violated it in civil trial," she added. "There is a lot of aggravating circumstances that might lead to, okay, you are someone who should get some type of incarceration."
