Fox Business attacks potential Trump appeals judge for giving $250 to Howard Dean

Fox Business aired an attack on judges who could be selected to hear an appeal of Donald Trump's 34 felony convictions in New York.

In a Tuesday segment, Fox News correspondent Eric Shawn told Fox Business host Stuart Varney that Trump's quest to overturn his convictions would be an "uphill struggle" because the New York appeals court was "dominated by Democrats."

Although Shawn did not provide any proof that appellate judges donated to Democrats in their current positions, he did find evidence of donations earlier in their careers.

For example, Justice Ellen Gesmer donated to Sen. Chuck Schumer (D-NY) 25 years ago and to then-Sen. Hillary Clinton (D-NY) in 2000. Shawn also noted that she gave $250 to Howard Dean's 2003 presidential campaign.

Justice Marsha Michael, the newest appointee to the court, was endorsed by New York Attorney General Letitia James when she ran for a State Assembly seat in 2014, Shawn said.

Shawn noted that the appellate court has ruled in Trump's favor in past cases. The report was followed by an interview with Sen. Ted Cruz (R-TX), who was "convinced" the U.S. Supreme Court would overturn Trump's conviction.

"This opinion, this verdict is an utter disgrace," Cruz said. "And I don't know if the New York State Court of Appeals will do anything to step in and reverse it, but if they don't, I am absolutely certain the U.S. Supreme Court will."
