Trump and Jack Smith get 'one more shot' to go at it over gag order: report

US District Judge Aileen Cannon on Thursday announced that she will provide Department of Justice special counsel Jack Smith and former President Donald Trump another chance to argue whether the MAGA leader should be issued a gag order in his Mar-a-Lago classified documents case — which will not go to trial anytime soon.

Politico's Kyle Cheney reported via X, "JUST IN: Judge Cannon is giving Trump and Jack Smith *one more shot* at arguing over a proposed gag order for Trump, setting a July 5 deadline for final briefs."

Cheney also shared Cannon's ruling, which reads: "In light of the extensive, newly submitted materials filed by the Special Counsel and Defendant Trump in support of and/or in opposition to the Special Counsel's Motion to Modify Conditions of Release, the Court will permit the parties to file one final supplemental brief in response to those newly submitted materials, not to exceed 10 double-spaced pages, on or before July 5, 2024."

The Trump-appointed judge's announcement comes just hours after Lawfare legal reporter Anna Bower tweeted Cannon "granted the ex-president another procedural delay."

While Cannon rejected the MAGA hopeful's lawyers' request for a hearing on whether "the FBI lied in its initial Mar-a-Lago search warrant," she gave the green light on "another hearing concerning attorney-client privilege."

Former US attorney and legal analyst Joyce Vance promptly responded to the news of another hearing, understanding that another hearing meaning more delay.

She wrote, "The standard for getting a Franks hearing (whether an agent/affiant lied in a search warrant) is very high-Trump wasn't close. But the decision to hold an evidentiary hearing after a hearing on legal arguments? Hard to see that as anything other than sheer delay. Ridiculous."
